The Town of Farragut vs Sean Murphy
Wednesday July 19th at 6pm, there will be a hearing at Farragut Town Hall, 11408 Municipal Center Dr, Farragut, TN 37934.
Below is a copy of the original complaint. Personal information has been redacted.
Some things to notice.
—This is a potential violation. All accused are innocent until proven guilty in court. —The regulation cited is incorrect. It is Section 109-12. (b). (5), not 109-12. (b). (1).
Farragut Municipal Codes
Sec. 109-6. - Definitions provides a definition of temporary parcel sign as
Temporary parcel sign means a sign permitted on a parcel for a temporary event or activity.
(5) Temporary parcel sign. Each individual house lot shall be permitted one temporary parcel sign not to exceed six square feet in area and six feet in overall height. This may include a sign where the owner consents and the property is being offered for sale or lease. A temporary parcel sign shall be removed within two days of the termination of the event/activity for which the sign was used. Where the termination of an event/activity is questioned by the sign administrator, the burden shall be on the sign holder to verify that the event/activity has not terminated.
Below is a photo of the current display.
A temporary parcel sign, per definition, discussing an event or activity, such as a graduation, bake sale, or the like.
This display is a set of memes. It does not at all represent an event nor an activity.
For reference, Mayor Ron Williams (right) and Aldermen Louise Povlin (left) and Scott Meyer (center).
Ron Williams was caught repeatedly talking to voters inside Farragut Town Hall during the 2022 Farragut Municipal Election. This is illegal under state and federal law. You have a right to ask why he has not been criminally charged for this. You can also ask the District Attorney’s Office why Scott Meyer was not criminally charged for filing a false police report that Alderman David White assaulted him.
You may also have noted that instead of his customary bow tie, a pair of handcuffs was put in its place. The photo below was taken from the town of Farragut’s website.
Mayor Williams and Alderman Povlin have a number of disciples and apologists who defend them on social media. One of them stated that the handcuffs is considered a threat. This is so comical. I guess some people have never watched South Park or Blazing Saddles.
—————————————————————————————————————
Alderman Povlin is known for stating anyone who opposes her and exposes her bad policy spreads misinformation.
Here are some examples:
—From Louise’s Farragut FYI Farragut Files Follies - #1
The accusations and insinuatios of wrongdoing continue without any actual evidence to back up the false claims.
—From Louise’s Farragut FYI More on the Biddle Farms project....
Regarding the Biddle Farms at Farragut Town Center, a false, convoluted, negative narrative filled with innuendo and insinuations of wrongdoing continues to be purveyed.
—Alderman Povlin's comments at the March 24, 2022 BoMA Meeting
Alderman Povlin states that a letter published in the Farragut Press contains misinformation…. The letter is in its entirety below.
I attended my first Farragut Board of (Mayor and) Aldermen meeting (March 10) over proposed zoning changes being considered. It was quite a learning experience.
It is highly unusual for a town to propose major zoning changes without someone filling out an application. I have served on my local zoning commission in my former hometown.
A governing body is supposed to be neutral and balance the rights of existing developed property and property owners who want to develop their property. The Farragut Aldermen, by leading the charge to make major changes, are giving the impression they are trying to pick winners and losers.
Vice Mayor Louise Povlin stated “… on Watt Road, do we really want another tire store?” It is neither her’s nor the Aldermen’s job to decide whether a business can exist or where it sets up. If the location can handle the activity on it, without significantly disrupting the neighbors and area in general, it should be approved.
The government has two main responsibilities in land use. First, creating and following a comprehensive plan to ensure the area can handle the activity. Atlanta did not follow this and paid the price. Raleigh-Durham and Nashville have followed this idea, and it shows. Farragut has needed a professionally designed plan for 20 years. Previous administrations have failed to do this, and the current one has some responsibility for not having a comprehensive plan. We are paying the price today because of it. Forty-five-minute waits to pick up your children at school is symptomatic of poor planning.
The second thing is to properly balance property rights of existing properties against the rights of undeveloped properties. For example, Alderman Povlin referenced the situation with (First) Baptist Church (Concord) wanting to install lights on their sports fields. The lights and resulting activity would be a major change of use. The lights would brighten up a normally dark area. The church can also hold events much later into the night, which would also disrupt the neighboring residences.
The neighborhoods were there first. Established laws and protocols would require the town to deny the lighting. I am perplexed as to why this is still being considered.
My impression after listening to comments from our Aldermen is they do not understand the proper role of government, as I have discussed here.
Alderman Povlin also stated “the Town of Farragut is often the applicant for changes.” Just because it has been done this way, does not mean it is the right way. That attitude in corporate America will get someone fired on the spot.
Farragut has a lot to do to improve how things are done here, and we need a serious focus to make sure we are following proper procedures and best practices. In this case, we are unfortunately not.
The Mad Queen aka the Queen of Hearts is from Alice in Wonderland. Given how verbally aggressive Louise is against anyone who speaks out against her, sounds like the shoe fits Cinderella.
Alderman Povlin made the following statement online.
All the display is is parody. Dehumanizing? Louise twice makes the statements that somehow this puts her personal safety in jeopardy. I do not recall ever personally speaking to Louise and the closest I recall being to her is when I was at the podium talking during public comment.
Her comments are grandstanding. No one has targeted her in any way. The real threats come from the person who sent me a letter threatening the safety of my family and my minor children. I have never heard of Louise denouncing it.
The real violence here is in fact with Louise Povlin supporters. Joe LaCroix, a former Farragut Town Employee, posted a copy of my vehicle and license plate on Next Door. There is a KCSO criminal investigation (personally confirmed by me). In addition, Mr. LaCroix went on a profanity laced tirade against me Sunday afternoon June 11th screaming “Fuck You” at least 20 times at me. The manager had to remove him from the area I was sitting. This is the real violence in Farragut.
Mr. LaCroix and Louise’s husband, Jay Povlin, have also posted on social media saying I put up coffins at my display. What you see in the photo here is all that has ever been in the display. Both of these males are bold faced liars.
Again with Ron and Louise’s disciples and apologists, some of them were on social media claiming this is a threat with the off with their heads comment. You should laugh at this nonsense. They need to go watch Alice in Wonderland again.
The truth is this meme is a perfect representation of the unprofessional conduct Louise Povlin is known for. She feels the need to correct anything anyone says who disagrees with her. Do you treat people like this? They do in Louise’s home state of New Jersey. I wish people would leave their liberal values and bad manners in the states they are fleeing from.
The real outrage over this is the memes made it impossible for Louise to run for County Commission. She cannot defend her tenure on BoMA. She cannot defend her vote for high rise apartments on Biddle Farms, her constant support for overbuilding, and her unacceptable demeanor in dealing with people who disagree with her.
The Scott Meyer meme is in regarding to his love of 10 foot wide lanes. You can hear this in Scott’s own words here.
Tractor Trailers need a minimum of 11 feet wide lanes to safely turn into an intersection. There was a proposal to shrink the lanes from Campbell Station Road to 10 feet wide in 2022. It was a very bad idea and deserves more mockery than a meme dressing Scott as Cupid.
You may also be wondering why there are so many chickens in this display. The original court date was supposed to be Monday June 12th. The town cancelled at 4pm, 2 hours before the scheduled hearing.
Amazing how gutless bullies are some times.
My display is protected First Amendment speech. It is very humorous and accurate parody of 3 terrible elected officials.
It is also clear that the Town of Farragut has targeted me because of my criticisms. My legal team has evidence showing the town knowingly ignored violations of the same ordinance they claimed I violated.
In addition, the ordinance Farragut claims I violated has nothing to do with my display.
Farragut has taken me to court over a regulation that has nothing to do with me, ignored other violations to drive by my property, and their regulations are unconstitutional based on US Supreme Court case law. This will be covered in depth at court Wednesday July 19th.
If you dare speak out against the Democratic People’s Republic of Farragutstan, expect the swift hand of tyranny to come down on you.
—Expect to be summoned to court over a regulation that has nothing to do with you.
—Expect the enforcement officer to be so sloppy and unprofessional that she cannot even get the correct regulation.
—Expect to have a deputy show up to you home to serve you out of uniform, in an unmarked car, and with a gun.
—Expect elected officials and their lemmings to put pressure on your Homeowners Association to cancel your pool card, that you have a right to and paid for. Yes this happened.
—Expect to be threatened with letters sent anonymously to your house, having your car doxxed online (which is a crime), and to be screamed at with profanity laced tirades while you are out with friends eating.
—Expect to be singled out because these people are unhinged bullies.
This type of nonsense has gone on in Farragut for decades.
It is going to end.
